Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Fix-It Registry website (the "Service") operated by Fix-It Registry ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, customers, repair experts, and others who access or use the Service.
1. The Service as a Venue/Marketplace
NATURE OF THE PLATFORM: Fix-It Registry acts exclusively as a directory, venue, and communication platform connecting individuals seeking repair services ("Customers") with independent professionals and businesses offering repair services ("Repair Experts").
NO EMPLOYMENT OR AGENCY RELATIONSHIP: We do not employ, recommend, or endorse any Repair Experts. Repair Experts are independent contractors and are not employees, partners, representatives, agents, joint venturers, independent contractors or franchisees of Fix-It Registry.
2. Dispute Resolution and Release of Liability
DISCLAIMER OF LIABILITY:Fix-It Registry is not a party to any agreement, contract, or arrangement entered into between Customers and Repair Experts. We have no control over and do not guarantee the quality, safety, legality, or suitability of any services provided by Repair Experts, the truth or accuracy of any listings, or the ability of Repair Experts to provide services.
IN THE EVENT OF A DISPUTE BETWEEN YOU (WHETHER A CUSTOMER OR A REPAIR EXPERT) AND ONE OR MORE OTHER USERS OF THE SERVICE, YOU HEREBY RELEASE FIX-IT REGISTRY, OUR OFFICERS, DIRECTORS, AGENTS, SUBSIDIARIES, JOINT VENTURES, AND EMPLOYEES FROM ANY AND ALL CLAIMS, DEMANDS, AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.
We are not responsible for any property damage, loss of items, personal injury, or unsatisfactory service results that occur as a result of transactions initiated through our Service. You agree that Fix-It Registry shall not be involved in any disputes, mediations, or legal proceedings between users.
3. User Responsibilities
For Customers: You are solely responsible for evaluating the qualifications, reviews, and suitability of any Repair Expert before engaging their services. You acknowledge that engaging a Repair Expert is at your own risk.
For Repair Experts: You represent and warrant that you possess the necessary skills, licenses, permits, and insurance to perform the repair services you offer. You agree to provide services in a professional and workmanlike manner.
4. Indemnification
You agree to defend, indemnify, and hold harmless Fix-It Registry and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms, or c) any dispute between you and another user of the platform.
5. Limitation of Liability
In no event shall Fix-It Registry, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
6. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
